These Terms & Conditions (“Terms”) govern your purchase of and participation in online courses, coaching programmes, and related services (“Programme”) offered by Heart iQ Network LLC (“Heart iQ,” “we,” “us”). By completing your purchase, you confirm that you have read, understood, and agree to be bound by these Terms.
Where a Programme includes in-person components (retreats, live gatherings, or workshops), additional venue-specific terms may apply and will be provided separately prior to the event.
“Programme” means the online course, coaching container, or training you have enrolled in, including all digital content, live coaching calls, community access, and any optional in-person components.
“Participant” or “You” means the individual who purchases or enrols in a Programme.
“Content” means all video, audio, written materials, worksheets, guides, and other resources provided as part of the Programme.
“Live Components” means scheduled group coaching calls, Q&A sessions, practice circles, or in-person gatherings included in the Programme.
- Full payment or the first instalment of an approved payment plan is due at the time of purchase. Your access to the Programme is contingent on receipt of payment.
- If you have selected a payment plan, you acknowledge and agree that the payment plan constitutes a binding financial commitment for the full Programme fee. By selecting a payment plan, you authorise Heart iQ (or its payment processor) to charge the agreed amounts on the scheduled dates. All instalments remain due in full regardless of whether you choose to continue participating in the Programme. A payment plan is not a subscription and cannot be cancelled mid-term. Failure to make a scheduled payment may result in suspension of access, referral to a collections agency, and/or legal action to recover the outstanding balance.
- All prices are listed in the currency stated on the sales page. You are responsible for any currency-conversion fees, bank charges, or applicable taxes.
- Where enrolment is processed by a local entity acting as booking agent on behalf of Heart iQ, the agent’s payment terms will be communicated at checkout. Your contractual relationship for Programme delivery remains with Heart iQ Network LLC.
- You may request cancellation of your enrolment by written notice to connect@heartiq.org.
- Online Programmes: You are entitled to a full refund if you submit a written cancellation request within 14 days of your purchase date, provided you have not substantially accessed or consumed the Programme Content. After 14 days from the date of purchase, all fees are non-refundable.
- In-Person Components: For any in-person retreat or workshop component included in a Programme, cancellations received more than 30 days before the event date are eligible for a full refund of the in-person component fee minus a 10% administrative fee. Cancellations received 15–30 days before the event are eligible for a 50% refund of the in-person component fee. Cancellations received fewer than 15 days before the event are non-refundable.
- If you are on a payment plan, cancellation of your participation does not cancel your payment obligation. The remaining balance remains due in full in accordance with the agreed payment schedule (see Section 2b).
- Heart iQ reserves the right to cancel or reschedule a Programme. In such cases, you will be offered a full refund or transfer to an alternative date at your election.
Important: By selecting a payment plan, you are agreeing to pay the full Programme fee. A payment plan is a binding commitment, not a subscription. You may not stop payments simply because you choose to stop participating.
- Access to digital Content is provided via our online learning platform. You will receive login credentials upon confirmed enrolment.
- Live Components are scheduled at times communicated in advance. Heart iQ will make reasonable efforts to accommodate multiple time zones but does not guarantee availability at all times.
- Recordings of live calls may be made available for a limited period at Heart iQ’s discretion. Not all live sessions are recorded.
- Programme access is granted for the duration stated on the sales page. After this period, access may be revoked unless an extension is offered.
- You are responsible for ensuring you have a stable internet connection and suitable device to access the Programme.
Certain Programmes may include optional or required in-person gatherings at venues in the Netherlands, the United States, or other locations as communicated.
- You are solely responsible for your own travel, accommodation, visa, insurance, and related costs unless explicitly stated otherwise.
- Venue-specific terms, including house rules, liability waivers, and local health & safety requirements, will be provided in advance and must be agreed to as a condition of attendance.
- Heart iQ reserves the right to change the venue or format (e.g., move an in-person session online) due to circumstances beyond its reasonable control. In such cases, no additional refund is owed for the change of format.
- All Content is the intellectual property of Heart iQ Network LLC and/or its founder, Christian Pankhurst, and is protected by copyright and other intellectual-property laws.
- Your enrolment grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Content for your personal, non-commercial purposes.
- You may not reproduce, distribute, publicly display, create derivative works from, or commercially exploit any Content without prior written consent from Heart iQ.
- Unauthorised sharing of Content, login credentials, or recordings is a material breach of these Terms and may result in immediate termination of access without refund.
By participating in any Programme, you agree to:
- Treat all participants, facilitators, and staff with respect and dignity.
- Maintain confidentiality of all personal information shared by other participants during live calls, circles, or group settings.
- Refrain from recording, screenshotting, or distributing any live session content without express permission.
- Follow the facilitation guidelines and community agreements provided at the start of the Programme.
Heart iQ reserves the right to remove any participant who violates the Code of Conduct, at its sole discretion, without refund.
- Heart iQ Programmes involve personal-development practices that may bring up strong emotions. You acknowledge that participation is voluntary and that you are solely responsible for your own physical, emotional, and psychological wellbeing.
- The Programme does not constitute therapy, medical advice, psychological counselling, or any other regulated health-care service. If you are currently under professional care for mental-health conditions, you are advised to consult your provider before participating.
- Heart iQ, its officers, employees, facilitators, and contractors shall not be held liable for any physical, emotional, psychological, or financial outcomes arising from your participation.
- Results are not guaranteed. Testimonials and case studies represent individual experiences and do not promise specific outcomes.
To the maximum extent permitted by applicable law:
- Heart iQ’s total aggregate liability to you for any claims arising out of or related to these Terms or the Programme shall not exceed the total fees you have actually paid for the Programme.
- In no event shall Heart iQ be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.
- Heart iQ is not liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to internet outages, natural disasters, pandemics, government actions, or third-party platform failures (“Force Majeure”).
- Heart iQ collects and processes personal data in accordance with its Privacy Policy, available at heartiq.org/privacy-policy.
- By enrolling, you consent to the collection of your name, email address, payment information, and Programme engagement data for the purposes of delivering the Programme and communicating with you.
- Heart iQ will not sell your personal data to third parties. Data may be shared with payment processors, platform providers, and booking agents strictly as necessary for Programme delivery.
- These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict-of-law provisions.
- Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.
- Nothing in these Terms limits your statutory consumer-protection rights under the laws of your country of residence, to the extent those rights cannot be waived by contract.
Heart iQ reserves the right to update these Terms at any time. Material changes will be communicated via email or posted on the Programme sales page. Continued participation after notice of changes constitutes acceptance of the revised Terms. The version in effect at the time of your enrolment governs your purchase unless you accept updated Terms.
